Again, this idiom does not do anything:

static assert(
     !is(typeof(this) == immutable),
     "PersistentList itself must be mutable for allocation / RC purposes"
);

The condition is always true.

Anyway, any design that does not allow e.g. nested lists is inadequate IMO.
